　　(Adopted at the 18th Meeting of the Standing Committee of the Seventh National People's Congress on March 2, 1991, promulgated by Order No. 41 of the President of the People's Republic of China on March 2, 1991, and effective as of October 1, 1991)

　　第一條 為了維護(hù)國徽的尊嚴(yán)，正確使用國徽，根據(jù)憲法，制定本法。

　　Article 1 This Law is enacted, in accordance with the Constitution, with a view to upholding the dignity of the National Emblem and ensuring the correct use of the National Emblem.

　　第二條 中華人民共和國國徽，中間是五星照耀下的天安門，周圍是谷穗和齒輪。

　　Article 2 The National Emblem of the People's Republic of China shall comprise the design of Tian' anmen in its centre illuminated by five stars and encircled by ears of grain and a cogwheel.

　　中華人民共和國國徽按照1950年中央人民政府委員會通過的《中華人民共和國國徽圖案》和中央人民政府委員會辦公廳公布的《中華人民共和國國徽圖案制作說明》制作。

　　The National Emblem of the People's Republic of China shall be made in accordance with the Design of the National Emblem of the People's Republic of China adopted by the Central People's Government Council in 1950, and the Directions for the Making of the Design of the National Emblem of the People's Republic of China promulgated by the General Office of the Central People's Government Council in the same year.

　　第三條 中華人民共和國國徽是中華人民共和國的象征和標(biāo)志。

　　Article 3 The National Emblem of the People's Republic of China is the symbol and hallmark of the People's Republic of China.

　　一切組織和公民，都應(yīng)當(dāng)尊重和愛護(hù)國徽。

　　All organizations and citizens shall respect and care for the National Emblem.

　　第四條 下列機(jī)構(gòu)應(yīng)當(dāng)懸掛國徽：

　　Article 4 The following organs shall hang the National Emblem:

　　(一)縣級以上各級人民代表大會常務(wù)委員會;

　　(1) The standing committees of the people's congresses at or above the county level;

　　(二)縣級以上各級人民政府;

　　(2) The people's governments at or above the county level;

　　(三)中央軍事委員會;

　　(3) The Central Military Commission;

　　(四)各級人民法院和專門人民法院;

　　(4) The people's courts at various levels and the special people's courts;

　　(五)各級人民檢察院和專門人民檢察院;

　　(5) The people's procuratorates at various levels and the special people's procuratorates;

　　(六)外交部;

　　(6) The Ministry of Foreign Affairs; and

　　(七)國家駐外使館、領(lǐng)館和其他外交代表機(jī)構(gòu)。

　　(7) The country's embassies, consulates and other diplomatic missions stationed in other countries.

　　鄉(xiāng)、民族鄉(xiāng)、鎮(zhèn)的人民政府可以懸掛國徽，具體辦法由省、自治區(qū)、直轄市的人民政府根據(jù)實(shí)際情況規(guī)定。

　　The people's governments of townships, nationality townships and towns may hang the National Emblem, specific measures for which shall be stipulated by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government in light of their actual conditions.

　　國徽應(yīng)當(dāng)懸掛在機(jī)關(guān)正門上方正中處。

　　The National Emblem shall be hung right in the middle on top of the front gate of the organ concerned.

　　第五條 下列場所應(yīng)當(dāng)懸掛國徽：

　　Article 5 The National Emblem shall be hung in the following places:

　　(一)北京天安門城樓，人民大會堂;

　　(1) The rostrum of Tian' anmen and the Great Hall of the People in Beijing;

　　(二)縣級以上各級人民代表大會及其常務(wù)委員會會議廳;

　　(2) The conference halls of the people's congresses at or above the county level and their standing committees;

　　(三)各級人民法院和專門人民法院的審判庭;

　　(3) Courtrooms of the people's courts at various levels and of the special people's courts; and

　　(四)出境入境口岸的適當(dāng)場所。

　　(4) Appropriate places of ports of exit or entry.

　　第六條 下列機(jī)構(gòu)的印章應(yīng)當(dāng)刻有國徽圖案：

　　Article 6 The seals of the following organs shall include the design of the National Emblem:

　　(一)全國人民代表大會常務(wù)委員會，國務(wù)院，中央軍事委員會，最高人民法院，最高人民檢察院;

　　(1) The Standing Committee of the National People's Congress, the State Council, the Central Military Commission, the Supreme People's Court and the Supreme People's Procuratorate;

　　(二)全國人民代表大會各專門委員會和全國人民代表大會常務(wù)委員會辦公廳、工作委員會，國務(wù)院各部、各委員會、各直屬機(jī)構(gòu)、國務(wù)院辦公廳以及國務(wù)院規(guī)定應(yīng)當(dāng)使用刻有國徽圖案印章的辦事機(jī)構(gòu)，中央軍事委員會辦公廳以及中央軍事委員會規(guī)定應(yīng)當(dāng)使用刻有國微圖案印章的其他機(jī)構(gòu)。

　　(2) The special committees of the National People's Congress and the General Office and the working commission of the Standing Committee of the National People's Congress, the ministries and commissions under the State Council, departments directly under the State Council, the General Office of the State Council and the administrative offices that shall, as prescribed by the State Council, use seals including the design of the National Emblem, as well as the General Office of the Central Military Commission and other organs that shall, as prescribed by the Central Military Commission, use seals including the design of the National Emblem;

　　(三)縣級以上地方各級人民代表大會常務(wù)委員會、人民政府、人民法院、人民檢察院，專門人民法院，專門人民檢察院;

　　(3) The standing committees of the local people's congresses, the local people's governments, the local people's courts, and the local people's procuratorates at or above the county level, as well as the special people's courts and the special people's procuratorates; and

　　(四)國家駐外使館、領(lǐng)館和其他外交代表機(jī)構(gòu)。

　　(4) The country's embassies, consulates and other diplomatic missions stationed in other countries.

　　第七條 下列文書、出版物等應(yīng)當(dāng)印有國徽圖案：

　　Article 7 There shall be printed on the following documents and publications the design of the National Emblem:

　　(一)全國人民代表大會常務(wù)委員會、中華人民共和國主席和國務(wù)院頒發(fā)的榮譽(yù)證書、任命書、外交文書;

　　(1) Certificates of honour, letters of appointment and diplomatic documents issued by the Standing Committee of the National People's Congress, the President of the People's Republic of China, and the State Council;

　　(二)中華人民共和國主席、全國人民代表大會常務(wù)委員會委員長、國務(wù)院總理、中央軍事委員會主席、最高人民法院院長和最高人民檢察院檢察長以職務(wù)名義對外使用的信封、信箋、請柬等;

　　(2) Envelopes, correspondence paper and invitation cards used in foreign affairs by the President of the People's Republic of China, the Chairman of the Standing Committee of the National People's Congress, the Premier of the State Council, the Chairman of the Central Military Commission, the President of the Supreme People's Court and the Procurator-General of the Supreme People's Procuratorate in their respective capacities;

　　(三)全國人民代表大會常務(wù)委員會公報(bào)、國務(wù)院公報(bào)、最高人民法院公報(bào)和最高人民檢察院公報(bào)的封面;

　　(3) Front covers of bulletins of the Standing Committee of the National People's Congress, the State Council, the Supreme People's Court and the Supreme People's Procuratorate; and

　　(四)國家出版的法律、法規(guī)正式版本的封面。

　　(4) Front covers of the official editions of laws and regulations published by the State.

　　第八條 外事活動和國家駐外使館、領(lǐng)館以及其他外交代表機(jī)構(gòu)對外使用國徽圖案的辦法，由外交部規(guī)定，報(bào)國務(wù)院批準(zhǔn)后施行。

　　Article 8 Measures for the use of the design of the National Emblem in activities of foreign affairs and by the country's embassies, consulates and other diplomatic missions stationed in other countries shall be prescribed by the Ministry of Foreign Affairs and submitted to the State Council for approval before implementation.

　　第九條 在本法規(guī)定的范圍以外需要懸掛國微或者使用國徽圖案的，由全國人民代表大會常務(wù)委員會辦公廳或者國務(wù)院辦公廳會同有關(guān)主管部門規(guī)定。

　　Article 9 Where the hanging of the National Emblem or the use of the design of the National Emblem is necessitated outside the scope specified in this Law, it shall be prescribed by the General Office of the Standing Committee of the National People's Congress or the General Office of the State Council, in conjunction with the departments concerned.

　　第十條 國徽及其圖案不得用于：

　　Article 10 The National Emblem and the design thereof shall not be used in:

　　(一)商標(biāo)、廣告;

　　(1) Trademarks or advertisements;

　　(二)日常生活的陳設(shè)布置;

　　(2) Furnishings or ornaments in everyday life;

　　(三)私人慶吊活動;

　　(3) Private activities of celebration or condolence; and

　　(四)國務(wù)院辦公廳規(guī)定不得使用國徽及其圖案的其他場合。

　　(4) Other circumstances where the National Emblem and the design thereof may not be used, as prescribed by the General Office of the State Council.

　　第十一條 不得懸掛破損、污損或者不合規(guī)格的國徽。

　　Article 11 No damaged, defiled, or substandard National Emblem shall be hung.

　　第十二條 懸掛的國徽由國家指定的企業(yè)統(tǒng)一制作，其直徑的通用尺度為下列三種：

　　Article 12 The National Emblem to be hung shall be uniformly made by enterprises designated by the State and the diameters of its usual dimensions shall be as follows:

　　(一)一百厘米;

　　(1) One hundred centimetres;

　　(二)八十厘米;

　　(2) Eighty centimetres; and

　　(三)六十厘米。

　　(3) Sixty centimetres.

　　在特定場所需要懸掛非通用尺度國徽的，報(bào)國務(wù)院辦公廳批準(zhǔn)。

　　The hanging, in special places, of the National Emblem in unusual dimensions shall be subject to the prior approval of the General Office of the State Council.

　　第十三條 在公眾場合故意以焚燒、毀損、涂劃、玷污、踐踏等方式侮辱中華人民共和國國徽的，依法追究刑事責(zé)任;

　　Article 13 Whoever desecrates the National Emblem of the People's Republic of China by publicly and wilfully burning, mutilating, scrawling on, defiling, or trampling upon it shall be investigated for criminal responsibility according to law;

　　情節(jié)較輕的，參照治安管理處罰條例的處罰規(guī)定，由公安機(jī)關(guān)處以十五日以下拘留。

　　if the circumstances are relatively minor, the offender shall, with reference to the provisions of the Regulations on Administrative Penalties for Public Security, be punished by the public security organ with a detention of not more than fifteen days.

　　第十四條 縣級以上各級人民政府對國徽的使用，實(shí)施監(jiān)督管理。

　　Article 14 The people's governments at or above the county level shall exercise supervision and control over the use of the National Emblem.

　　第十五條 本法自1991年10月1日起施行。

　　Article 15 This Law shall enter into force as of October 1, 1991.

　　Appendix I: THE DESIGN OF THE NATIONAL EMBLEM OF THE PEOPLE'S REPUBLIC OF CHINA

　　說明：國徽的內(nèi)容為國旗、天安門、齒輪和麥稻穗。象征中國人民自五四運(yùn)動以來的新民主主義革命斗爭和工人階級領(lǐng)導(dǎo)的以工農(nóng)聯(lián)盟為基礎(chǔ)的人民民主專政的新中國的誕生。

　　Caption: Comprising the National Flag, Tian'anmen, a cogwheel and ears of wheat and rice, the National Emblem symbolizes the new-democratic revolutionary struggle waged by the Chinese people since the May 4th Movement in 1919, as well as the birth of the New China under the people's democratic dictatorship led by the working class and based on the alliance of workers and peasants.

　　附件二：中華人民共和國國徽圖案制作說明

　　Appendix II: DIRECTIONS FOR THE MAKING OF THE DESIGN OF THE NATIONAL EMBLEM OF THE PEOPLE'S REPUBLIC OF CHINA

　　(Promulgated by the General Office of the Central Government Council on September 20, 1950)

　　一、兩把麥稻組成正圓形的環(huán)。齒輪安在下方麥稻桿的交叉點(diǎn)上。齒輪的中心交結(jié)著紅綬。紅綬向左右綰住麥稻而下垂，把齒輪分成上下兩部。

　　1. Two bunches of wheat and rice form a round ring. A cogwheel is placed where the wheat and rice stems cross at the base. Red ribbon forms a knot in the centre of the cogwheel. The red ribbon coils up the wheat and rice on the left and right of the cogwheel and hangs down, dividing the cogwheel into an upper and a lower part.

　　二、從圖案正中垂直畫一直線，其左右兩部分，完全對稱。

　　2. If a vertical straight line is drawn in the centre of the design, the left and the right parts thereof are completely symmetrical.

　　三、圖案各部分之地位、尺寸，可根據(jù)方格墨線圖之比例，放大或縮小。

　　3. The positions and measurements of the various parts of the design may be enlarged or reduced to the scale of the squared ink line sketch.

　　四、如制作浮雕，其各部位之高低，可根據(jù)斷面圖之比例放大或縮小。

　　4. If a relief sculpture is made, the height of the various parts may be magnified or lessened to the scale of the sectional drawing.

　　五、國徽之涂色為金紅二色：麥稻、五星、天安門、齒輪為金色，圓環(huán)內(nèi)之底子及垂綬為紅色;紅為正紅(同于國旗)，金為大赤金(淡色而有光澤之金)。

　　5. The National Emblem is in red and gold: the wheat and rice, the five stars, Tian' anmen and the cogwheel are in gold, the base of the part within the round ring and the hanging ribbon are in red; the red is pure red (the same as the National Flag), the gold is pure gold (light and bright).
