　　YOUR GUEST TICKET CONTRACT CONTAINS IMPORTANT LIMITATIONS ON THE RIGHTS OF PASSENGERS. IT IS IMPORTANT THAT YOU CAREFULLY READ ALL TERMS OF THIS CONTRACT, PAYING PARTICULAR ATTENTION TO SECTION 3 AND SECTIONS 9 THROUGH 11, WHICH LIMIT OUR LIABILITY AND YOUR RIGHT TO SUE, AND RETAIN IT FOR FUTURE REFERENCE.

　　THIS CONTRACT REQUIRES THE USE OF ARBITRATION FOR CERTAIN DISPUTES AND WAIVES ANY RIGHT TO TRIAL BY COURT TO RESOLVE THOSE DISPUTES. PLEASE READ SECTION10 BELOW.

　　1. INTRODUCTION 介紹

　　This Guest Ticket Contract (the Ticket Contract) describes the terms and conditions that will apply to the relationship between the Passenger (as defined in Section 2.g below) and the Carrier (as defined in Section 2.b below) of the Vessel with respect to the Cruise or Cruise Tour covered by this Agreement. Except as otherwise expressly provided herein, this Agreement supersedes any other written or oral representations or agreements between Carrier and Passenger relating to the subject matter of this Agreement or the Cruise or the Cruise Tour, but excluding the terms of the Cruise Lines International Association (CLIA) Passenger Bill of Rights that the Vessel's Operator has adopted as a requirement of being a member of CLIA (the CLIA Passenger Bill of Rights).

　　就本協(xié)議項(xiàng)下的游輪巡游和游輪觀光，本乘客票據(jù)合同(下稱 票據(jù)合同)規(guī)定了適用于游輪乘客(定義見(jiàn)下述第2.g條)和承運(yùn)人(定義見(jiàn)下述第2.b條)之間關(guān)系的條款和條件。除非本合同另有其它明確規(guī)定，本協(xié)議將取代承運(yùn)人和乘客就本協(xié)議標(biāo)的或游輪巡游/游輪觀光所作出或達(dá)成的任何其它書面或口頭聲明或協(xié)議，但游輪的運(yùn)營(yíng)方為符合國(guó)際郵輪協(xié)會(huì)(下稱郵輪協(xié)會(huì))的會(huì)員要求而已采用的國(guó)際郵輪協(xié)會(huì)乘客權(quán)利法案(下稱郵輪協(xié)會(huì)乘客權(quán)利法案)的條款除外。

　　Purchase or use of this Ticket Contract, whether or not signed by the Passenger, shall constitute the agreement by Passenger, on behalf of himself and all other persons traveling under this Ticket Contract (including any accompanying minors or other persons for whom the Ticket Contract was purchased), to be bound by the terms and conditions of this Ticket Contract. This Ticket Contract cannot be modified except in a writing signed by a corporate officer of Carrier. In addition, Passenger acknowledges the availability of and Passenger agrees to abide by the terms and conditions, including but not limited to certain payment terms such as minimum deposit requirements and payment due dates, which appear in the applicable Carrier brochure or online at www.royalcaribbean.com, www.rcclchina.com.cn or, where applicable, as advised by your travel agent. In the event of any conflict between Carrier's brochure or website materials and this Ticket Contract, the terms of this Ticket Contract shall prevail.

　　無(wú)論乘客是否簽署了本票據(jù)合同，只要其作出了購(gòu)買或使用本票據(jù)合同的行為，均視為乘客已代表自己及其他所有在本票據(jù)合同項(xiàng)下的游客(包括但不限于隨行未成年人及其他本合同項(xiàng)下的同行客人)同意受本票據(jù)合同條款和條件之約束。除非經(jīng)承運(yùn)人高級(jí)職員的書面簽署，否則不得對(duì)本票據(jù)合同進(jìn)行任何修改。除此之外，乘客確認(rèn)其可獲得并應(yīng)遵守承運(yùn)人產(chǎn)品手冊(cè)、網(wǎng)址www.royalcaribbean.com, 或www.rcclchina.com.cn或旅行社告知的條件和條款，包括但不限于某些付款條款如最低訂金要求及到期付款日條款。若上述手冊(cè)或網(wǎng)頁(yè)資料與本票據(jù)合同的規(guī)定出現(xiàn)了任何沖突之處，則應(yīng)適用本票據(jù)合同之規(guī)定。

　　2. DEFINITIONS 定義

　　a. Agreement or Contract means the terms and conditions set forth in this Ticket Contract together with the Cruise or CruiseTour Fare due for Your Cruise or CruiseTour. Together, the items described in the preceding sentence shall constitute an agreement between Passenger and Carrier for the Cruise or CruiseTour.

　　協(xié)議或合同指本票據(jù)合同規(guī)定的條款和條件，以及您因本游輪/游輪觀光而需支付的游輪巡游/游輪觀光費(fèi)用。上述所列的項(xiàng)目共同構(gòu)成乘客和承運(yùn)人就游輪巡游/游輪觀光而達(dá)成的全部協(xié)議。

　　b. "Carrier" shall include: (i) the Vessel, or any substituted ship; (ii) the Vessel's Carrier as more particularly detailed at Section 20); and (iii) with respect to the Land Tour portion of any CruiseTour, the operator of that Land Tour (LTO) together with the owners, managers, charterers, affiliates, successors and assigns of the entities identified in subsections (i), (ii) and (iii) of this sentence. Carrier also shall include the officers, directors, employees, Representatives, crew or pilots of the entities identified in the preceding sentence. The exclusions or limitations of liability of Carrier set forth in the provisions of this Ticket Contract, as well as all rights, defenses or immunities set forth herein, shall also apply to and be for the benefit of Representatives, independent contractors, concessionaires and suppliers of Carrier, as well as owners and Carriers of all shoreside properties at which the Vessel or the Transport may call, as well as owners, designers, installers, suppliers and manufacturers of the Vessel or Transport, or any component parts of either, together with the employees and servants of each of the foregoing, and/or any launches, craft or facilities of any kind belonging to or provided by any of the parties identified in this paragraph.

　　c. Cruise means the specific cruise covered by this document, as the same may be modified and shall include those periods during which the Guest is embarking or disembarking the Vessel and those periods when the Guest is on land while the Vessel is in port.

　　d. Cruise or CruiseTour Fare includes the amount due for the Cruise or Cruise Tour, whether such amounts are owing and/or have been paid by the Passenger, but does not include amounts due for other products or services such as air transportation, photographs, gratuities, telephone calls, or medical services which can be purchased separately, nor does it include government or quasi-governmental taxes and fees, whether assessed on a per Passenger, per vessel, per berth or per ton basis, nor any fuel surcharges, security surcharges or similar assessments made by airlines, trains, buses, hotels or other third parties which are subject to change and are due and payable by Passenger upon request. For CruiseTours that include air travel, airfare is included in the CruiseTour Fare.

　　游輪巡游/游輪觀光費(fèi)用指為本游輪巡游或游輪觀光應(yīng)支付的費(fèi)用，無(wú)論該費(fèi)用是否已由乘客進(jìn)行支付，但其不包括如航空運(yùn)輸、照片、娛樂(lè)活動(dòng)、電話、或醫(yī)療服務(wù)等其他可另行購(gòu)買的產(chǎn)品或服務(wù)的費(fèi)用，不包括任何政府機(jī)關(guān)或準(zhǔn)政府機(jī)關(guān)就乘客、游輪、泊位或游輪噸位所征收的任何稅費(fèi)，不包括任何航空公司、鐵路公司、汽車公司、酒店或其它任何第三方所征收的任何燃油附加費(fèi)、安保附加費(fèi)或其它任何類似費(fèi)用(且上述公司或第三方有權(quán)對(duì)上述費(fèi)用的數(shù)額進(jìn)行調(diào)整，且在其要求支付時(shí)，乘客應(yīng)將上述費(fèi)用及時(shí)支付給上述公司或第三方)。對(duì)于包含航空旅行項(xiàng)目的游輪觀光活動(dòng)而言，其航空費(fèi)用均已包含在游輪觀光費(fèi)用之中。

　　Carrier reserves the right to impose a supplemental charge relating to unanticipated occurrences including, but not limited to, increases in the price of fuel. Any such supplement charges may apply, at Carrier's sole discretion, to both existing and new bookings (regardless of whether such bookings have been paid in full). Such supplements are not included in the Cruise or CruiseTourFare.

　　承運(yùn)人保留在發(fā)生不可預(yù)期情形(包括但不限于燃料費(fèi)用的增加)時(shí)，收取附加費(fèi)用的權(quán)利。承運(yùn)人可自行決定對(duì)已有的和新建的預(yù)訂收取任何該等附加費(fèi)用(無(wú)論乘客此前是否已全額支付了預(yù)訂的的費(fèi)用)。上述附加費(fèi)用未包括在游輪巡游/游輪觀光費(fèi)用之中。

　　e. Cruise Tour shall mean the combined vacation package officially published and offered by Carrier, which includes the applicable cruise and associated Land Tour.

　　游輪觀光指由承運(yùn)人正式公布并提供的綜合度假產(chǎn)品，包括相關(guān)的游輪巡游和陸地游項(xiàng)目。

　　f. Carrier of the Vessel means the entity identified in Section 20 below.

　　游輪的承運(yùn)人指下述第20條中所列的相關(guān)實(shí)體。

　　g. "Passenger" or Guest or You means all persons traveling under this Ticket Contract and persons in their care, together with their respective heirs and representatives. "Passenger" shall include the plural and the use of the masculine shall include the feminine.

　　"乘客"、游客或您指在本票據(jù)合同項(xiàng)下出游的所有人員及受其監(jiān)護(hù)的其他人，以及上述人員的各自繼承人和代理人。"乘客" 的單數(shù)形式將含有復(fù)數(shù)意思，任何表示男性乘客的用詞同樣包含女性乘客。

　　h. Land Tour shall mean the land tour component of a Cruise Tour to be provided either prior to the initial embarkation on the cruise or after the final debarkation from the cruise.

　　陸地游指游輪觀光中所包含的陸地游覽項(xiàng)目，該陸地游可在巡游首次登船之前提供，也可在巡游完成最后離船之后提供。

　　i. Transport means the railcars, buses and other modes of transportation or accommodation provided by LTO in connection with a Land Tour.

　　交通工具指陸地游運(yùn)營(yíng)方為陸地游而提供的有軌客車、公交車及其它任何運(yùn)輸或交通工具。

　　j. "Vessel" means the ship owned or chartered or operated by Carrier on which Passenger may be traveling or against which Passenger may assert a claim, as well as any substituted ship used in the performance of this Ticket Contract.

　　"游輪"指由承運(yùn)人所有的、承租的或運(yùn)營(yíng)的且乘客用其出游或針對(duì)其提出索賠請(qǐng)求的船只，以及為履行本票據(jù)合同而使用的其它任何替代船只。

　　3. BAGGAGE, PROPERTY AND LIMITATIONS OF LIABILITY 行李、財(cái)產(chǎn)和責(zé)任限制

　　a. Baggage Limits and Prohibited Items. Each adult Passenger is permitted to carry onboard the Vessel or check-in only the wearing apparel and personal effects reasonably necessary for the cruise, including suitcases, trunks, valises, satchels, bags, hangers containing clothing, toiletries and similar items. In no event shall any Passenger bring on board the Vessel or check-in, or in connection with the Land Tour, any illegal controlled substances, fireworks, live animals (except under the terms of Section 12.d below), weapons, firearms, explosives or other hazardous materials, or any other items prohibited by applicable law or Carrier policy. Carrier reserves the right to refuse to permit any Passenger to take on board the Vessel or on any mode of Transport any item Carrier deems inappropriate.

　　行李限制和禁止物品. 每一成年乘客允許攜帶上船并辦理登船手續(xù)的行李僅限于本次游輪觀光活動(dòng)合理所需的衣物和個(gè)人物品，包括手提箱、行李箱、旅行袋、背包、手提包、含衣物的衣架、化妝品和類似物品。在任何情況下，在上船、辦理登船手續(xù)或陸地游活動(dòng)之時(shí)，任何乘客均不得攜帶任何非法的管制物品、煙火、活體動(dòng)物(但以下第12.d條中另有其它規(guī)定的除外)、武器、軍火、爆炸物品、其它危險(xiǎn)物品或任何其它相關(guān)法律或承運(yùn)人政策禁止的物品。對(duì)于乘客所攜帶的任何物品，若承運(yùn)人認(rèn)為其不符合相關(guān)要求，則承運(yùn)人有權(quán)拒絕乘客將該物品攜帶上船或攜帶至任何交通工具。

　　b. Liability for Loss of or Damage to Baggage. Unless negligent, Carrier is neither responsible nor liable for any loss of or damage to Passenger's property, whether contained in luggage or otherwise. Liability for loss of or damage to Passenger's property in connection with any air or ground transportation shall be the sole responsibility of the provider of the service and in accordance with applicable limitations.

　　行李損失或損毀的責(zé)任. 無(wú)論行李是否打包裝箱，承運(yùn)人均無(wú)需對(duì)乘客行李的任何損失或損毀負(fù)責(zé)，除非承運(yùn)人對(duì)該損失或損毀負(fù)有過(guò)失責(zé)任。對(duì)于在任何航空運(yùn)輸或陸上運(yùn)輸過(guò)程中乘客財(cái)產(chǎn)所產(chǎn)生的損失或損毀，其責(zé)任均應(yīng)由該等運(yùn)輸服務(wù)的提供商單獨(dú)承擔(dān)，并適用相關(guān)責(zé)任限制之規(guī)定。

　　c. Limitation of Liability for Lost or Damaged Property. Notwithstanding any other provision of law or this Agreement, Carrier's liability for loss or damage to property during the Land Tour portion of a CruiseTour is limited to $300.00 per Passenger. Notwithstanding any other provision of law or this Agreement, Carrier's liability for loss or damage to property for the cruise (or for the cruise only portion of a CruiseTour) is limited to $300.00 per Passenger, unless Passenger declares the true value of such property in writing and pays Carrier within 10 days of final payment for the cruise, a fee of five percent (5%) of the amount that such value exceeds $300.00. In such event, Carrier's liability shall be limited to its true declared value, but not exceeding $5,000.

　　財(cái)產(chǎn)丟失或損毀的責(zé)任限制. 無(wú)論法律或本協(xié)議中另有其它任何規(guī)定，對(duì)于在游輪觀光過(guò)程中的陸地游部分乘客所出現(xiàn)的任何財(cái)產(chǎn)丟失或損毀，承運(yùn)人就此承擔(dān)的責(zé)任限定于每位乘客$300.00美元。無(wú)論法律或本協(xié)議中另有其它任何規(guī)定，對(duì)于在游輪巡游(或游輪觀光中的游輪巡游部分)中乘客的財(cái)產(chǎn)丟失或損毀，承運(yùn)人責(zé)任限定為每位乘客$300.00美金，除非乘客事先就財(cái)產(chǎn)的真實(shí)價(jià)值進(jìn)行了書面申報(bào)，并在游輪巡游款項(xiàng)全部最終支付后的10日內(nèi)，就超出$300.00美元的部分按照5%的比例向承運(yùn)人支付了費(fèi)用。在此情形下，承運(yùn)人責(zé)任限于該財(cái)產(chǎn)的申報(bào)價(jià)值，但最高不超過(guò)$5,000美金。

　　d. Limited Carriage. Carrier does not undertake to carry as baggage any tools of trade, household goods (including but not limited to appliances and furniture), fragile or valuable items, precious metals, jewelry, documents, negotiable instruments or other valuables, including but not limited to those specified in Title 46 of the United States Code, Appendix Section 181. Each Passenger warrants that no such item will be presented to Carrier within any receptacle or container as baggage, and hereby releases Carrier from any liability whatsoever for loss of or damage to such items when presented to Carrier in breach of this warranty. In no event shall Carrier be liable for normal wear or tear of luggage or property, or loss of or damage to jewelry, cash, negotiable paper, photographic/electronic, medical or recreational equipment, dental hardware, eyewear, medications or other valuables unless they are deposited with Carrier on the Vessel for safekeeping against receipt (LOTs do not accept valuables for deposit). Carrier's liability, if any, for loss of or damage to valuables so deposited shall not exceed the amounts indicated in Section 3.c above.

　　攜帶物品限制. 承運(yùn)人不保證乘客可將任何營(yíng)生用品、家用物品(包括但不限于器具及家具)、易碎物品或高價(jià)物品、貴金屬、珠寶、文件、可流通票據(jù)或其它貴重物品作為行李進(jìn)行攜帶，包括但不限于美國(guó)法典第46章附錄第181條所列的物品。每位乘客承諾不會(huì)將上述物品放置在任何容器或箱柜中作為行李交付承運(yùn)人，若乘客違反此承諾將該等物品交付承運(yùn)人，則免除承運(yùn)人對(duì)上述物品滅失或毀損的任何責(zé)任。在任何情況下，承運(yùn)人均無(wú)需對(duì)其行李或財(cái)產(chǎn)的正常損耗承擔(dān)責(zé)任，且無(wú)需對(duì)其珠寶、現(xiàn)金、可流通票據(jù)、攝像設(shè)備/電子設(shè)備、醫(yī)療器具或娛樂(lè)設(shè)施、牙科硬件、眼鏡、藥品或其它貴重物品的損失或損毀承擔(dān)責(zé)任，除非乘客已將上述貴重物品在船上交付給承運(yùn)人保管且由承運(yùn)人出具代保管證明(陸地游運(yùn)營(yíng)方不接受對(duì)貴重物品的寄存)。承運(yùn)人所保管的任何貴重物品如丟失或損毀，承運(yùn)人承擔(dān)的責(zé)任將不得超出上述第3.c條中規(guī)定的賠償限額。

　　4. MEDICAL CARE AND OTHER PERSONAL SERVICES 醫(yī)療護(hù)理和其它個(gè)人服務(wù)

　　a. Availability of Medical Care.Due to the nature of travel by sea and the ports visited, the availability of medical care onboard the Vessel and in ports of call may be limited or delayed and medical evacuation may not be possible from the Vessel while at sea or from every location to which the Vessel sails.

　　b. Relationship with Service Providers. To the extent Passengers retain the services of medical personnel or independent contractors on or off the Vessel, Passengers do so at their sole risk. Any medical personnel attending to a Passenger on or off the Vessel, if arranged by Carrier, are provided solely for the convenience of the Passenger, work directly for the Passenger, and shall not be deemed to be acting under the control or supervision of the Carrier, as Carrier is not a medical provider. Likewise, any onboard concessions (including but not limited to the gift shops, spas, beauty salon, art program, photography, formalwear concessions) are either operated by or are independent contractors on board the Vessel, on Transport or elsewhere and are provided solely for the convenience of Passenger. Even though the Carrier shall be entitled to charge a fee and earn a profit for arranging such services, all such persons or entities shall be deemed independent contractors and not acting as agents or representatives of Carrier. Carrier assumes no liability whatsoever for any treatment, failure to treat, diagnosis, misdiagnosis, actual or alleged malpractice, advice, examination or other services provided by such persons or entities. Guest acknowledges that the Vessel's hair dresser, manicurist, art auctioneer, gift shop personnel, spa personnel, wedding planners and other providers of merchandise and personal services are employees of independent contractors and that Carrier is not responsible for their actions.

　　與服務(wù)提供商之間的關(guān)系. 若乘客在船上或船下接受任何醫(yī)護(hù)人員或獨(dú)立合同方提供的醫(yī)護(hù)服務(wù)，則所產(chǎn)生的一切風(fēng)險(xiǎn)均應(yīng)由該乘客自行承擔(dān)。承運(yùn)人在船上或船下為本船乘客所安排的任何醫(yī)護(hù)人員，均僅是為了便利乘客之目的而提供的，該等醫(yī)護(hù)人員直接為乘客提供服務(wù)，不應(yīng)被視為是在承運(yùn)人的控制或監(jiān)管下提供服務(wù)，因?yàn)槌羞\(yùn)人并非醫(yī)療服務(wù)提供商。同樣的，本游輪、交通工具或其它地方的任何特許服務(wù)項(xiàng)目(包括但不限于禮品店、Spas、美容沙龍、藝術(shù)品展、攝影服務(wù)或正裝特許經(jīng)營(yíng)店)，均是獨(dú)立合同方或由獨(dú)立合同方承包商自行運(yùn)營(yíng)，提供該等服務(wù)僅是為乘客便利之目的。盡管承運(yùn)人有權(quán)就上述服務(wù)的安排收取費(fèi)用并獲取收益，但上述所有人員或?qū)嶓w應(yīng)被視為是獨(dú)立合同方，而并非是作為承運(yùn)人的代理人或代表行事。對(duì)于該等人員或?qū)嶓w所提供的任何醫(yī)護(hù)服務(wù)、疏于提供醫(yī)護(hù)服務(wù)、診斷、誤診、實(shí)際或被指控的治療失當(dāng)、建議、檢查或其它服務(wù)，承運(yùn)人均無(wú)需承擔(dān)任何責(zé)任。乘客確認(rèn)：本游輪上的美發(fā)化妝師、美甲師、藝術(shù)品拍賣人、禮品店工作人員、Spa工作人員、婚禮規(guī)劃師及提供其它商品和個(gè)人服務(wù)的提供者均為獨(dú)立合同方的員工，承運(yùn)人無(wú)需對(duì)上述人員的任何行為承擔(dān)任何責(zé)任。

　　c. Payment for Medical or Personal Care Services. Passenger shall pay for all medical care or other personal services requested or required, whether onboard or ashore, including the cost of any emergency medical care or transportation incurred by Carrier and any costs associated with the provision of medical services as provided in the CLIA Passenger Bill of Rights. If Passenger is unable to pay and the Carrier pays for such expenses, then Passenger shall reimburse Carrier for those expenses.

　　醫(yī)護(hù)服務(wù)或個(gè)人護(hù)理服務(wù)的付款. 乘客應(yīng)就其在船上或船下所要求或申請(qǐng)的任何醫(yī)護(hù)服務(wù)或其它個(gè)人服務(wù)支付所有服務(wù)費(fèi)用，上述服務(wù)費(fèi)用包括由承運(yùn)人墊付的任何緊急醫(yī)療護(hù)理費(fèi)或交通費(fèi)，以及為提供郵輪協(xié)會(huì)乘客權(quán)利法案規(guī)定的醫(yī)療服務(wù)而產(chǎn)生的任何費(fèi)用。在乘客無(wú)力支付上述服務(wù)費(fèi)且承運(yùn)人代其支付了該服務(wù)費(fèi)后，乘客應(yīng)就該代付費(fèi)用向承運(yùn)人進(jìn)行償還。

　　5. SHORE EXCURSIONS, TOURS, FACILITIES OR OTHER TRANSPORTATION

　　岸上短途觀光、觀光游、設(shè)施或其它交通

　　All arrangements made for or by Passenger for transportation (other than on the Vessel) before, during or after the Cruise or CruiseTour of any kind whatsoever, as well as air arrangements, shore excursions, tours, hotels, restaurants, attractions and other similar activities or services, including all related conveyances, products or facilities, are made solely for Passenger's convenience and are at Passenger's risk. The providers, owners and Carriers of such services, conveyances, products and facilities are independent contractors and are not acting as Representatives or representatives of Carrier. Even though Carrier may collect a fee for, or otherwise profit from, making such arrangements and offers for sale shore excursions, tours, hotels, restaurants, attractions, the Land Tour and other similar activities or services taking place off the Vessel for a profit, it does not undertake to supervise or control such independent contractors or their employees, nor maintain their conveyances or facilities, and makes no representation, whether express or implied, regarding their suitability or safety. In no event shall Carrier be liable for any loss, delay, disappointment, damage, injury, death or other harm whatsoever to Passenger which occurs on or off the Vessel or the Transport as a result of any acts, omissions or negligence of any independent contractors. For the avoidance of doubt, any shore excursion or other services Passenger may purchase from a Travel Representative should be subject to terms and conditions agreed between Travel Representative and Passenger, and Carrier assumes no liability for any loss, delay, disappointment, damage, injury, death or other harm whatsoever to Passenger which occurs during shore excursion or performance of such other services.

　　由承運(yùn)人為乘客安排的或乘客自行安排的在游輪巡游/游輪觀光活動(dòng)之前、之中或之后的任何交通服務(wù)(本游輪上的航行除外)，以及任何的航空運(yùn)輸服務(wù)、岸上短途觀光、觀光游、酒店、餐館、游覽項(xiàng)目及其它類似活動(dòng)或服務(wù)(包括所有相關(guān)的運(yùn)輸、產(chǎn)品或設(shè)施)，均應(yīng)視為是專為乘客的便利而提供的，且由乘客自行承擔(dān)風(fēng)險(xiǎn)。上述服務(wù)、運(yùn)輸、產(chǎn)品和設(shè)施的提供商、所有人和承運(yùn)人均為獨(dú)立合同方，而并非作為承運(yùn)人的代理人或代表行事。盡管承運(yùn)人就其安排或提供以供乘客購(gòu)買的岸上短途觀光、觀光游、酒店、餐館、游覽項(xiàng)目、陸地游項(xiàng)目及其他類似的在船下提供的盈利活動(dòng)或服務(wù)，可能會(huì)收取費(fèi)用或從中盈利，但承運(yùn)人無(wú)義務(wù)對(duì)上述獨(dú)立合同方或其員工的行為進(jìn)行監(jiān)督或控制，無(wú)義務(wù)提供運(yùn)輸工具或設(shè)施，也不就上述活動(dòng)或服務(wù)的適當(dāng)性或安全性做出任何明示或默示的聲明。在任何情況下，若因上述任何獨(dú)立合同方的任何行為、過(guò)失或過(guò)錯(cuò)之原因，而使乘客在船上、船下或上述交通工具上遭受了任何損失、延誤、不滿、損害、人身傷害、死亡或其它任何傷害，承運(yùn)人均不應(yīng)對(duì)此承擔(dān)任何責(zé)任。為免疑惑，乘客從旅行代表處所購(gòu)買的岸上短途觀光或其他服務(wù)，應(yīng)由其與該旅行代表所同意的條件和條款進(jìn)行約束，承運(yùn)人對(duì)于該等岸上短途觀光或其他服務(wù)的履行過(guò)程中乘客所遭受的任何損失、延誤、不滿、損害、人身傷害、死亡或其他任何傷害，不承擔(dān)任何責(zé)任。

　　6. CANCELLATION, DEVIATION OR SUBSTITUTION BY CARRIER

　　承運(yùn)人所作的取消、變更或更換

　　a. Carrier cannot guarantee that the Vessel will call at every port of call or follow every part of the itinerary. Itineraries may change from time to time, both before and after departure. Whilst Carrier always endeavors to avoid changes and cancellations, under certain circumstances, Carrier may find it necessary to cancel, advance, postpone or deviate from any scheduled sailing, port of call, destination, lodging or any activity on or off the Vessel, or substitute another vessel or port of call, destination, lodging or activity. Where possible, Carrier will try to give notice to Passenger or its Travel Representative of any change or cancellation. Unless otherwise provided in Section 6.d and 6.e, Carrier shall not be liable for any claim whatsoever by Passenger, including but not limited to loss, compensation or refund, by reason of such cancellation, advancement, postponement, substitution or deviation.

　　承運(yùn)人無(wú)法保證游輪會(huì)在每一個(gè)?？扛劭谕？炕蛲耆凑疹A(yù)定行程進(jìn)行航行。在起航前或起航后，行程可能會(huì)不時(shí)發(fā)生變更。盡管承運(yùn)人始終會(huì)努力避免對(duì)行程進(jìn)行任何變更或取消，在某些情況下，承運(yùn)人可能需要將預(yù)定的起航時(shí)間、停靠港、目的港、客房或其它任何船上或船下活動(dòng)予以取消、提前、延后或變更，或更換游輪、?？扛?、目的港、客房或其它活動(dòng)項(xiàng)目?？尚械那闆r下，承運(yùn)人會(huì)盡力將變更或取消通知乘客或其旅行代表。除第6.d和第6.e款另有規(guī)定外，就上述任何取消、提前、延后、更換或變更行為，承運(yùn)人均無(wú)需對(duì)乘客的任何索賠請(qǐng)求負(fù)責(zé)，包括但不限于損失、賠償或退款。

　　b. By way of example, and not limitation, Carrier may, deviate from any scheduled sailing and may otherwise land Passenger and her property at any port if Carrier believes that the voyage or any Passenger or property may be hindered or adversely affected as a result of hostilities, blockages, prevailing weather conditions, labor conflicts, strikes onboard or ashore, breakdown of Vessel, congestion, docking difficulties, medical or life saving emergencies or any other cause whatsoever.

　　舉例而言(不局限于此舉例情形)，若承運(yùn)人認(rèn)為發(fā)生了任何不利情形(如敵意行為、封鎖、不利天氣條件、勞資沖突、船上或岸上罷工、船體故障、阻塞、入港困難、醫(yī)療或人命救助緊急情況或其它任何原因)從而可能導(dǎo)致航程、任何乘客或財(cái)產(chǎn)受到侵害或其它不利影響，則承運(yùn)人有權(quán)改變預(yù)定航線和/或?qū)⒊丝图捌湄?cái)產(chǎn)運(yùn)至其它任何港口。

　　c. Carrier shall have the right to comply with any orders, recommendations, or directions whatsoever given by any governmental entity or by persons purporting to act with such authority and such compliance shall not be deemed a breach of this Agreement entitling the Passenger to assert any claim for liability, compensation or refund.

　　對(duì)于由任何政府機(jī)關(guān)(或代表上述政府機(jī)關(guān)執(zhí)行公務(wù)的人員)所做出的任何命令、建議或指示，承運(yùn)人均有權(quán)予以遵守，且該遵守行為不構(gòu)成承運(yùn)人對(duì)本協(xié)議的違約，乘客也無(wú)權(quán)因此提出要求承運(yùn)人承擔(dān)任何責(zé)任、賠償或退款的索賠請(qǐng)求。

　　d. Cancellation, deviation or substitution may also be caused by a Force Majeure Event. Force Majeure Event refers to incidents that cannot be predicted, avoided and overcome, including but not limited to Acts of God, breakdown of the Vessel, hostilities, blockades, labor conflicts, strikes aboard or ashore, restraint of rulers or princes, war, fire, collision, directions of underwriters, arrest, order or restraint by governmental authorities or others, acts of terrorism, civil commotions, weather conditions and considerations of safety of the Vessel (of which the Master shall be the sole judge), foundering of the Vessel or breakdowns of or damage to its hull, machinery and fittings (which Carrier could not have anticipated or avoided despite our normal comprehensive mechanical checks), inability to secure or failure of supplies including fuel, requisition of the Vessel or other circumstances beyond the Carrier's control (including but not limited to a change in Carrier's fleet deployment caused by any of the aforementioned events). The followings shall apply in circumstances of cancellation, deviation or substitution by Carrier caused by a Force Majeure Event:

　　不可抗力事件也可能導(dǎo)致行程取消、變更或更換。不可抗力事件是指無(wú)法預(yù)見(jiàn)、避免和克服的事件，包括但不限于天災(zāi)、游輪故障、敵視行為、封鎖、勞資沖突、船上或岸上罷工、政府扣押或管制、戰(zhàn)爭(zhēng)、火災(zāi)、沖突、保險(xiǎn)公司指令、逮捕、政府機(jī)關(guān)或其它主管機(jī)關(guān)限制或命令、恐怖活動(dòng)、民眾騷亂、天氣條件、以及有關(guān)游輪安全問(wèn)題(船長(zhǎng)是唯一裁斷者)、游輪浸水或船體、機(jī)械部件及固定部件的故障或損壞(承運(yùn)人經(jīng)慣常及全面的機(jī)械檢查仍不可預(yù)見(jiàn)或避免的情況)、無(wú)法保證或未能獲取包括燃料在內(nèi)的供給、游輪被征用、或其它超出承運(yùn)人控制范圍的情況(包括但不限于因任何前述事件導(dǎo)致的承運(yùn)人運(yùn)力配置變更)。當(dāng)不可抗力事件導(dǎo)致承運(yùn)人做出任何取消、變更或更換時(shí)，應(yīng)適用下述規(guī)定：

　　d.1 Pre departure, if Carrier is forced to cancel a cruise completely due to a Force Majeure Event (a change to the itinerary or substitution of ports of call shall not be deemed cancellation of a cruise), the sole liability of Carrier, shall be for refund to Passenger or Travel Representative (when booked through a Travel Representative) the payment received for your booking within thirty (30) days. Passenger booking through a Travel Representative should contact your Travel Representative for refund.

　　起航前，如果承運(yùn)人因不可抗力事件被迫徹底取消游輪行程(行程的變更或停靠港口的更換不應(yīng)被視為是行程的取消)，承運(yùn)人所需承擔(dān)的唯一責(zé)任是在三十(30)天內(nèi)，向乘客或其旅行代表(如果乘客是通過(guò)旅行代表訂票的話)退還承運(yùn)人所收取的訂票費(fèi)用。通過(guò)旅行代表訂票的乘客請(qǐng)聯(lián)系您的旅行代表有關(guān)退款事宜。

　　d.2 Pre departure, if itinerary change is required due to a Force Majeure Event and is deemed to have an adverse impact on the overall holiday experience, Passenger will have the following options: (i) accept the changed arrangements, in which case Carrier will, within thirty (30) days, refund to Passenger or its Travel Representative an amount, if any, calculated according to Section 6.d.3 below; or (ii) cancel the cruise, in which case Carrier will, within thirty (30) days, refund to Passenger or its Travel Representative 50% of the Cruise Fare received for your booking, plus port taxes and fees and, when shore excursion is purchased from Carrier, the shore excursion fee refunded to Carrier.

　　起航前，如果因?yàn)椴豢煽沽κ录枰兏谐糖以摰茸兏鼤?huì)對(duì)整體度假體驗(yàn)造成不利影響，則乘客應(yīng)享有以下選擇權(quán): (i) 接受變更后的行程安排，該等情況下，承運(yùn)人將按照下述第6.d.3款在三十(30)天內(nèi)向乘客或其旅行代表退還費(fèi)用(如有);(ii)取消行程，該等情況下，承運(yùn)人將在三十(30)天內(nèi)向乘客或其旅行代表退回承運(yùn)人收取的訂票費(fèi)用的50%，港務(wù)稅費(fèi)，以及承運(yùn)人收到的岸上短途觀光費(fèi)用的退款(如果岸上短途觀光是通過(guò)承運(yùn)人購(gòu)買的話)。

　　d.3 If Passenger chooses the first option mentioned in Section 6.d.2 above and accepts the changed arrangements, the refund, if any, will be made by Carrier to Passenger or its Travel Representative as follows: (i) if Carrier finds it impossible to complete the itinerary and has to shorten a cruise due to a Force Majeure Event, Carrier shall make a prorated refund to Passenger or its Travel Representative of the sum received for such booking for the number of days eliminated from the cruise itinerary. For purposes of this Section, each Cruise day shall be deemed to commence at 12:01 A.M. (local time). Any cruise that is canceled after 12:01 P.M. (local time) shall be deemed to be a full day of completed cruise. The time involved in returning to port of embarkation shall be deemed to be included in the cruise time, provided all services and accommodations are available onboard to Passengers at that time. (ii) if departure is delayed, call at a port is shortened, or returning to destination port is delayed, but the number of days remains the same, Carrier shall not be liable for any refund or compensation, but all services and accommodations will be made available onboard to Passengers. (iii) if port(s) of call is cancelled or substituted and Carrier receives a refund of port taxes and fees and/or shore excursion fee (for shore excursion purchased from Carrier only) due to such cancellation or substitution, Carrier shall refund such amount to Passenger or its Travel Representative.

　　如果乘客選擇上述第6.d.2款下規(guī)定的第一種方案接受變更后的行程安排，則退款(如有)將按照如下規(guī)定由承運(yùn)人退回給乘客或其旅行代表：(i)如果承運(yùn)人認(rèn)為不可抗力事件導(dǎo)致無(wú)法完成游輪行程而需要縮減行程天數(shù)，則承運(yùn)人應(yīng)根據(jù)游輪行程中被縮減的巡游天數(shù)占總巡游天數(shù)的比例，將收取的訂票費(fèi)用按比例退還給乘客或其旅行代表。為本條款之目的，每一巡游日應(yīng)視為從當(dāng)?shù)貢r(shí)間上午 12:01開(kāi)始。若任何巡游在當(dāng)?shù)貢r(shí)間下午12:01之后取消，應(yīng)當(dāng)被視為該日整日的巡游活動(dòng)已經(jīng)完成。將游客送返至登船港口途中的時(shí)間應(yīng)被包括在巡游時(shí)間內(nèi)，承運(yùn)人應(yīng)向乘客提供游輪上的所有服務(wù)和住宿。(ii) 如果起航延誤、港口?？繒r(shí)間縮短或返回目的港延誤，但行程天數(shù)不減少，則承運(yùn)人無(wú)需承擔(dān)賠償或退款的任何責(zé)任，而船上將向乘客提供各項(xiàng)服務(wù)和住宿。(iii)如果?？扛劭诒蝗∠蚋鼡Q且因?yàn)樵摰热∠蚋鼡Q使得承運(yùn)人收到了港務(wù)稅費(fèi)及/或岸上短途觀光費(fèi)用(如果岸上短途觀光是通過(guò)承運(yùn)人購(gòu)買的話)的任何退款，則承運(yùn)人應(yīng)將該等退款退回至乘客或其旅行代表。

　　d.4 After commencement of the cruise, if any deviation or substitution is required due to a Force Majeure Event, the sole liability for Carrier is (i) to refund Passenger or its Travel Representative any port taxes and fees and/or shore excursion fee (for shore excursion purchased from Carrier only) which are refunded to Carrier due to such changes, and/or (ii) when cruise is shortened, to refund to Passenger or its Travel Representative, a prorated refund of the sum received for Passenger's booking for the number of days eliminated from the cruise itinerary. Refund shall be made within thirty (30) days after the end of the cruise.

　　游輪行程開(kāi)始后，如果因不可抗力事件需要進(jìn)行任何行程變更或更換，承運(yùn)人需要承擔(dān)的唯一責(zé)任為: (i)如承運(yùn)人因該等變更獲得任何港務(wù)稅費(fèi)及/或岸上短途觀光費(fèi)用(如果岸上短途觀光是通過(guò)承運(yùn)人購(gòu)買的話)的退款，則承運(yùn)人應(yīng)將該等退款退回給乘客或其旅行代表;及/或(ii)游輪行程被縮減的情況下，根據(jù)游輪行程被縮減的巡游天數(shù)所占總行程巡游天數(shù)的比例，向乘客或其旅行代表按比例退還收取的訂票費(fèi)用。退款應(yīng)在游輪行程結(jié)束后三十(30)天內(nèi)進(jìn)行。

　　e. In the event that a Cruise (or the cruise component of a CruiseTour) is cancelled or terminated early due to mechanical failures: (i) Passenger shall have a right to a full refund of the Cruise Fare if the Cruise is cancelled in full, or a partial refund if the cruise is terminated early; (ii) Carrier may cover or reimburse Passenger for additional costs (e.g. airline change fees) as deemed appropriate by the Carrier; (iii) if Passenger has travelled to the Vessel, Passenger shall have a right to transportation (by means selected by the Carrier) to the Vessel's scheduled port of disembarkation or the Passenger's home city; and (iv) Passenger shall have a right to lodging (selected by the Cruise Line) if disembarkation and an overnight stay in an unscheduled port are required due to the Cruise or cruise component of a CruiseTour being cancelled or terminated early because of such mechanical failures.

　　如果因?yàn)闄C(jī)械故障導(dǎo)致游輪巡游(或游輪觀光中的游輪巡游部分)被取消或提前終止，則(i)若游輪巡游被完全取消，乘客享有巡游巡游費(fèi)用全額退款的權(quán)利;若游輪巡游被提前終止，則享受部分退款;(ii)承運(yùn)人可在其認(rèn)為適當(dāng)?shù)姆秶鷥?nèi)承擔(dān)或補(bǔ)償乘客的額外費(fèi)用(如機(jī)票改簽費(fèi)用);(iii) 若乘客已到達(dá)游輪，乘客有權(quán)享有交通服務(wù)(按照乘客選擇的交通方式)將其送至游輪預(yù)定的到達(dá)港或乘客所屬城市;并且(iv)若因游輪巡游或游輪觀光中的游輪巡游部分被取消或提前終止導(dǎo)致乘客需要在非預(yù)定港口下船并過(guò)夜，則乘客有權(quán)享有游輪公司選擇安排的住宿服務(wù)。

　　f. Passenger, on behalf of himself and all other persons traveling under this Ticket Contract (including any accompanying minors or other persons for whom the Ticket Contract was purchased), agrees that should Passenger have any concern, issue or dispute in connection with the itinerary change, such matter should be dealt with in a legal and appropriate way. Under no condition should Passenger engage in demonstrations, protests or other behavior onboard which, in the Carrier's opinion, is detrimental to the onboard atmosphere, the enjoyment of the cruise by other guests. Passenger should not compel Carrier to assume any liability by way of refusal to embark or disembark the Vessel, behave in any other extreme ways to protest (e.g. sit-ins, gatherings in public areas of the ship, inciting others to protest), interrupt the normal operation or sailing of the Vessel, or otherwise act in violation of the Guest Conduct Policy and laws or regulations of countries that are involved in the cruise. Passengers shall at all times comply with notices from the ship's Captain and shall in addition comply with the Carrier's Guest Conduct Policy. Failure to comply with this Section may subject Passenger to actions Carrier may take pursuant to Guest Conduct Policy, and Carrier may also hold Passenger liable for any losses it may suffer therefrom.

　　乘客代表自己及其他所有在本票據(jù)合同項(xiàng)下的游客(包括但不限于隨行未成年人及其他本合同項(xiàng)下的同行客人)同意，若其對(duì)于行程變更有任何疑惑、問(wèn)題或糾紛，應(yīng)通過(guò)適當(dāng)且合法的方式解決。在任何情況下，乘客都不得參與船上的示威游行、抗議或其它承運(yùn)人視為將會(huì)對(duì)船上氣氛、其他乘客的游輪旅游享受造成不利影響的行為。乘客不得通過(guò)拒絕登船或離船的方式脅迫承運(yùn)人承擔(dān)任何責(zé)任，或干擾游輪的運(yùn)營(yíng)或航行，或通過(guò)極端的方式進(jìn)行抗議(如靜坐抗議、在游輪公共區(qū)域聚集、唆使其他游客加入抗議活動(dòng)等)，或采取其它違反乘客行為守則以及游輪航行所涉及的國(guó)家的法律法規(guī)的行為。乘客應(yīng)始終遵守游輪船長(zhǎng)的通知，并遵守承運(yùn)人的乘客行為守則。若乘客未能遵守本條款之規(guī)定，可能導(dǎo)致承運(yùn)人根據(jù)乘客行為守則采取措施，并要求乘客就其行為可能給承運(yùn)人造成的損失承擔(dān)責(zé)任。

　　7. CANCELLATION OR EARLY DISEMBARKATION BY PASSENGER

　　乘客所做之取消或提前離船

　　a. If a Passenger books the cruise from a Travel Representative, then your Cruise or Cruisetour Fares, including but not limited to any fuel or other supplemental charges, government taxes and fees and other charges are established by your travel representative that took your booking and not the Carrier. Similarly, the payment schedule for your Cruise or Cruisetour Fares is established by your travel representative that took your booking and not the Carrier. In addition, all cancellation and refund policies for your Cruise or Cruisetour fares are established by your travel representative that took your booking and not the Carrier.

　　如果乘客是通過(guò)旅行代表訂票的，則您的游輪巡游或游輪觀光費(fèi)用，包括但不限于任何燃料或其他附加收費(fèi)、政府稅費(fèi)和其他收費(fèi)均是為您訂票的旅行代表所設(shè)定的，而不是承運(yùn)人。同樣，您的游輪或游輪觀光費(fèi)用付款時(shí)間表，均是您訂票的旅行代表所設(shè)定的，而不是承運(yùn)人。此外，所有針對(duì)您的游輪或游輪觀光費(fèi)用的取消和退款政策均是為您訂票的旅行代表所設(shè)定，而不是承運(yùn)人。

　　b. Any refund due to Passenger as a result of cancellation by Passenger both prior to or after the Cruise or CruiseTour has begun shall be established and determined by the travel representative that took your booking who shall have sole liability for any refunds, where applicable. In the event of cancellation by the Passenger pre cruise, or early disembarkation of the Passenger for any reason, including pursuant to any provision of this Ticket Contract, such disembarkation shall be without refund, compensation, or liability on the part of the Carrier whatsoever.

　　游輪巡游或游輪觀光開(kāi)始之前或開(kāi)始后，任何因乘客取消行程而導(dǎo)致的退款應(yīng)由為您訂票的旅行代表確定和決定，且若需要退款的話，退款的責(zé)任應(yīng)由該旅行代表獨(dú)立承擔(dān)。若因任何原因(包括按照本票據(jù)合同規(guī)定)乘客在游輪巡游開(kāi)始前取消行程或提前離船，該等情況下承運(yùn)人不需要退款、賠償或承擔(dān)任何責(zé)任。

　　c. If a Passenger books the cruise from a Travel Representative, any payments of the Cruise or CruiseTour Fares shall be made to the Travel Representative and not the Carrier. If Carrier received payment from your travel Representative, the refund will be provided back to that Travel Representative, unless otherwise agreed by Carrier and Travel Representative.

　　如果乘客是通過(guò)旅行代表訂票的，則有關(guān)游輪巡游或游輪觀光費(fèi)用的任何款項(xiàng)應(yīng)當(dāng)向該旅行代表支付，而不是向承運(yùn)人支付。如果承運(yùn)人收到來(lái)自您的旅行代表的付款，則除非承運(yùn)人和旅行代表另有約定，退款將退回至該旅行代表處。

　　d. Passenger acknowledges that for certain voyages, such as a round-trip voyage commencing in a United States port, the Passenger must complete the entire voyage and that failure to do so may result in a fine or other penalty being assessed by one or more governmental agencies. Passenger hereby agrees to pay any such fine or penalty imposed because Passenger failed to complete the entire voyage and to reimburse Carrier in the event it pays such fine or penalty.
